1. Acceptance of Terms

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", or "your") and Hive Ventures Ltd, a company registered in England and Wales (company number 15933757), trading as ActivityHive.fun, FamilyTravelHive.com, and other affiliated brands (collectively, "Company", "we", "us", or "our") governing your access to and use of ActivityHive.fun and all associated services, features, and content (collectively, the "Service" or "Platform").

BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.

If you are entering into this Agreement on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms, and references to "you" shall refer to such entity.

2. Definitions

For purposes of this Agreement:

  • "Platform" refers to ActivityHive.fun and all affiliated services within the Family Travel Hive ecosystem, including but not limited to FamilyTravelHive.com.
  • "Content" means any information, text, graphics, photos, videos, data, or other materials uploaded, posted, or otherwise made available through the Service.
  • "User Content" means Content that Users submit, post, or transmit through the Service.
  • "Organizer" means a User who creates, publishes, or manages listings for activities, events, classes, or meetups.
  • "Listing" means any activity, event, class, workshop, camp, or meetup posted by an Organizer.

3. Description of Service

ActivityHive.fun operates as a community platform facilitating connections between families and activity providers. The Service enables Users to:

  • Discover and register for after-school activities, classes, workshops, holiday camps, and similar programs;
  • Create, organize, or participate in family meetups, playdates, and social gatherings;
  • Access information regarding family-friendly events and experiences;
  • Connect with other families based on shared interests, child age ranges, and geographic proximity;
  • Access curated content and resources provided through the Hive Ventures Ltd network.

The Company acts solely as a platform provider and intermediary. We may collect, curate, and add listings for activities, events, and programs from various sources including third-party providers, public information, and direct submissions. The Company does not organize, sponsor, supervise, or assume responsibility for any activities, events, or interactions facilitated through the Service, whether such listings are user-submitted or curated by the Company.

Activities and listings displayed on the Platform may originate from multiple sources. The Company makes no representations or warranties regarding the accuracy, availability, safety, or suitability of any listed activities. Users are solely responsible for verifying all information directly with activity providers before participation.

4. Unified Account System and Affiliated Services

ActivityHive.fun is operated as part of the Hive Ventures Ltd ecosystem. Your account credentials provide single sign-on access to ActivityHive.fun, FamilyTravelHive.com, and other affiliated services operated by Hive Ventures Ltd ("Unified Account").

By creating an account on any Platform within our ecosystem, you acknowledge and consent that:

  • Your account information, profile data, and User Content may be accessible across all affiliated Platforms;
  • Your registration constitutes acceptance of these Terms across all affiliated services;
  • Data collected through any Platform may be shared within the Family Travel Hive ecosystem to provide integrated services;
  • You authorize the Company to maintain a single, unified user profile across all affiliated Platforms.

5. Cross-Platform Publishing and Content Distribution

User Content, including but not limited to Listings, reviews, and community posts submitted to ActivityHive.fun, may be published, displayed, or distributed across FamilyTravelHive.com and other affiliated Platforms to enhance visibility and reach within our network.

Organizers may manage visibility settings for individual Listings through the organizer dashboard, including designating Listings as public, private, or invite-only. The Company reserves the right to determine the appropriate distribution channels for Content based on User-selected visibility preferences and platform policies.

By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, distribute, display, and publish such Content across all affiliated Platforms for the purpose of operating and promoting the Service.

6. Account Registration and Eligibility

To access certain features of the Service, you must register for an account. You represent and warrant that:

  • You are at least 18 years of age or the age of majority in your jurisdiction;
  • All registration information you submit is accurate, complete, and current;
  • You will maintain the accuracy of such information;
  • You have the legal capacity to enter into this Agreement;
  • You are not prohibited from using the Service under applicable law.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify the Company of any unauthorized access to or use of your account.

The Service is intended for use by adults only. Children under the age of 18 must not create accounts or use the Service except under the direct supervision of a parent or legal guardian.

6A. Parental Responsibility and Children's Information

If you provide information about your children as part of your family profile, you represent, warrant, and agree that:

  • You are the parent or legal guardian of any child about whom you provide information;
  • You have the legal authority to provide such information and consent to its use as described in these Terms and our Privacy Policy;
  • You are solely responsible for determining what information about your children is appropriate to share;
  • You will not provide children's full names, photographs that clearly identify individual children, exact birth dates, school names, or other information that could be used to identify or contact your children on publicly visible portions of the Platform;
  • You will exercise reasonable care and discretion when sharing any information about your children with other users, organizers, or activity providers;
  • You understand that other users may be able to view certain information about your children (such as age ranges and interests) for the purpose of family matching and activity recommendations;
  • You will supervise your children's exposure to and use of the Platform at all times;
  • You are solely responsible for ensuring your children's online safety and privacy;
  • You will not allow children under 18 to create accounts or use the Service without your direct supervision.

THE COMPANY ASSUMES NO RESPONSIBILITY FOR INFORMATION ABOUT CHILDREN THAT YOU CHOOSE TO SHARE. YOU RELEASE THE COMPANY FROM ANY LIABILITY ARISING FROM YOUR DISCLOSURE OF INFORMATION ABOUT YOUR CHILDREN OR FROM YOUR CHILDREN'S USE OF OR EXPOSURE TO THE SERVICE.

The Company reserves the right to remove any content that includes inappropriate or identifying information about children, or to suspend or terminate accounts that violate these provisions, at our sole discretion and without prior notice.

7. Family Verification Services

The Company offers optional verification services to enhance community trust and safety. Verification may be conducted through video calls, document verification, or other approved authentication methods.

Verified status does not constitute an endorsement, guarantee, certification, or warranty by the Company regarding user identity, character, background, trustworthiness, safety, or suitability for any purpose. Verification is provided solely as a community feature and does not eliminate risks inherent in online interactions or in-person meetings. The Company conducts no background checks, safeguarding assessments, or criminal record verification as part of the verification process.

The Company reserves the right to revoke verification status at any time without notice for violation of these Terms or for any other reason at our sole discretion.

8. Meetups and User-Organized Gatherings - Safety Warning

IMPORTANT SAFETY NOTICE: THE COMPANY DOES NOT ORGANIZE, SUPERVISE, VET, OR TAKE RESPONSIBILITY FOR ANY MEETUPS, PLAYDATES, OR USER-ORGANIZED GATHERINGS FACILITATED THROUGH THE SERVICE.

When participating in meetups or user-organized gatherings, you acknowledge and agree that:

  • You participate entirely at your own risk and are solely responsible for your own safety and the safety of any children in your care;
  • You must conduct your own due diligence, background checks, and safety assessments before meeting anyone from the Platform;
  • You should meet in public places, inform trusted persons of your plans, and follow standard personal safety protocols;
  • The Company does not verify the identity, background, intentions, or suitability of any users, including those organizing or attending meetups;
  • Verification status, if displayed, does not indicate that a user has been background-checked or is safe to meet;
  • You should never share personal information (such as home addresses) until you have established trust through appropriate vetting;
  • You are responsible for supervising children at all times and ensuring appropriate adult-to-child ratios;
  • The Company has no liability for any harm, injury, loss, or damage arising from meetups or in-person interactions.

Parents and guardians are strongly advised to: verify the identity of other participants; meet in well-populated public locations; bring another trusted adult when meeting someone for the first time; trust your instincts and leave if you feel uncomfortable; and report any suspicious or concerning behavior to local authorities and to the Company.

9. Organizer Terms and Responsibilities

Users who operate as Organizers and publish Listings agree to and represent that:

  • All information provided in Listings is accurate, complete, and not misleading, including dates, times, pricing, age requirements, capacity limitations, and safety information;
  • They possess all necessary licenses, permits, insurance, and authorizations required by applicable law to conduct the listed activities;
  • They will honor all accepted registrations and bookings, subject to force majeure or other legitimate cancellation circumstances;
  • They maintain appropriate liability insurance coverage for all activities offered;
  • They comply with all applicable laws, regulations, and industry standards, including those pertaining to child safety, safeguarding, supervision, and duty of care;
  • They are solely responsible for the safety, conduct, and management of all listed activities and events.

The Company does not verify Organizer credentials, qualifications, insurance coverage, licensing, permits, or compliance with legal requirements. The Company does not conduct background checks, safeguarding assessments, or DBS (Disclosure and Barring Service) checks on Organizers. Users participate in Organizer-led activities entirely at their own risk and must conduct their own due diligence before participation.

10. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Violating any applicable local, state, national, or international law or regulation;
  • Infringing upon or misappropriating the intellectual property rights of others;
  • Submitting false, misleading, or fraudulent information;
  • Impersonating any person or entity or falsely stating or misrepresenting your affiliation with any person or entity;
  • Engaging in harassment, abuse, threats, or intimidation of other Users;
  • Transmitting any unsolicited advertising, promotional materials, spam, or commercial solicitations;
  • Interfering with or disrupting the Service or servers or networks connected to the Service;
  • Attempting to gain unauthorized access to any portion of the Service or any other systems or networks;
  • Using automated systems or software to extract data from the Service ("scraping");
  • Posting or transmitting any Content that contains viruses, malware, or other harmful code;
  • Posting Content that is unlawful, defamatory, obscene, pornographic, or otherwise objectionable;
  • Using the Service for any illegal purpose or to facilitate illegal activity.

11. Intellectual Property Rights

The Service, including all Content, features, functionality, software, text, graphics, logos, images, and the compilation thereof (excluding User Content), is owned by the Company or its licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include any right to: (a) resell or make commercial use of the Service; (b) modify, reproduce, or create derivative works of the Service; (c) use any data mining, robots, or similar data gathering methods; or (d) download any portion of the Service except as expressly permitted.

Unauthorized use of the Service or any Content may violate applicable laws and is strictly prohibited.

12. User Content and License Grant

You retain all ownership rights to your User Content. By submitting User Content to the Service, you grant the Company a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid-up, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such User Content in any media formats and through any media channels, now known or hereafter developed, for the purposes of operating, providing, promoting, and improving the Service.

You represent and warrant that: (a) you own or have the necessary rights to submit the User Content; (b) your User Content does not violate the privacy rights, publicity rights, intellectual property rights, or other rights of any third party; and (c) posting your User Content does not result in a breach of contract between you and any third party.

The Company does not claim ownership of User Content and has no obligation to monitor User Content. However, we reserve the right to remove, edit, or disable access to any User Content at any time and for any reason without notice.

13. Third-Party Services and Links

The Service may contain links to third-party websites, applications, services, or resources that are not owned or controlled by the Company. The Company has no control over and assumes no responsibility for the content, privacy policies, terms of use, or practices of any third-party services.

You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such third-party services. We strongly advise you to read the terms and conditions and privacy policies of any third-party services that you visit or use.

14. Data Collection and Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge and consent to the collection, use, storage, and disclosure of your information as described in the Privacy Policy.

You acknowledge that information collected through the Service, including personal information, usage data, and User Content, may be shared within the Hive Ventures Ltd ecosystem to provide integrated services, personalize user experiences, improve service quality, and deliver relevant content across affiliated Platforms.

15. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

THE COMPANY DOES NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

THE COMPANY EXPRESSLY DISCLAIMS ALL LIABILITY FOR THE ACTS, OMISSIONS, AND CONDUCT OF ANY THIRD-PARTY SERVICE PROVIDERS, ORGANIZERS, ACTIVITY PROVIDERS, OR OTHER USERS. YOU ACKNOWLEDGE THAT THE COMPANY HAS NO OBLIGATION TO SCREEN, VERIFY, VET, BACKGROUND-CHECK, OR MONITOR USERS, ORGANIZERS, OR LISTINGS. THE COMPANY DOES NOT ENDORSE, VERIFY, OR GUARANTEE THE ACCURACY, SAFETY, LEGALITY, OR QUALITY OF ANY ACTIVITIES, EVENTS, MEETUPS, OR LISTINGS ON THE PLATFORM, WHETHER SUCH LISTINGS ARE USER-SUBMITTED OR CURATED BY THE COMPANY. YOUR USE OF THE SERVICE AND PARTICIPATION IN ANY ACTIVITIES, EVENTS, OR MEETUPS IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR ANY PERSONAL INJURY, HARM TO CHILDREN, ASSAULT, THEFT, PROPERTY DAMAGE, OR OTHER DAMAGES RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (E) PARTICIPATION IN ANY ACTIVITIES, EVENTS, MEETUPS, OR INTERACTIONS FACILITATED THROUGH THE SERVICE; OR (F) ANY CURATED OR LISTED ACTIVITIES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT THE COMPANY HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

THE COMPANY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective directors, officers, employees, agents, contractors, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party rights, including intellectual property, privacy, or publicity rights; (e) your violation of any applicable law or regulation; or (f) your participation in any activities, events, or interactions facilitated through the Service.

17. Termination and Suspension

The Company may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

You may terminate your account at any time by contacting us at support@activityhive.fun. Upon such termination, you remain bound by these Terms, including the license grants and other obligations that survive termination.

18. Modifications to Terms

The Company reserves the right, at its sole discretion, to modify or replace these Terms at any time. Material changes will be communicated to Users via email notification to the address associated with your account or through a prominent notice on the Service at least thirty (30) days prior to the effective date of such changes.

Your continued use of the Service following notification of changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.

19. Modifications to Service

The Company reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice at any time. You agree that the Company shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

20. Dispute Resolution and Governing Law

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS AND HOW DISPUTES BETWEEN YOU AND THE COMPANY ARE RESOLVED.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. You irrevocably submit to the jurisdiction of such courts and waive any objection to proceedings in such courts on the grounds of venue or on the grounds that proceedings have been brought in an inconvenient forum.

Notwithstanding the foregoing, the Company may seek equitable relief (including injunctive relief) in any court of competent jurisdiction to prevent infringement of intellectual property rights or disclosure of confidential information.

21. Consumer Rights (UK Users)

If you are a consumer resident in the United Kingdom, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation. You have certain legal rights which cannot be excluded or limited by these Terms.

Where we supply digital content to you, we will use reasonable skill and care in doing so and will ensure that such content is free from defects and fit for purpose. If the digital content is faulty, you may be entitled to a repair, replacement, or refund in accordance with your statutory rights.

22. General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.

Assignment: You may not assign or transfer these Terms or your rights hereunder without the Company's prior written consent. The Company may assign these Terms without restriction.

Force Majeure: The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control.

No Agency: Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and the Company.
